TERMS AND CONDITIONS

These Terms and Conditions govern the relationship between users (“you”, "your", "customer(s)", "recipient(s)") of our website www.cotswoldedgehampersuk.co.uk (the “website”) and Cotswold Edge Hampers Limited (the “Company”, ”we”, ”us”, ”our”) whose registration number is 12635285 and whose registered office is Bibstone House, Wotton-under-Edge, Gloucestershire, GL12 8AD.

By making a purchase from the website or from the Company by phone or email, you agree to be bound by the terms at the time of the transaction.

The right to update the terms from time to time is reserved by us and any changes will be shown on the website.

You warrant that the personal information you provide through the process of purchasing or subsequently is true, accurate, current and complete in all respects.   You warrant you are not impersonating any other person or entity.  You warrant you have provided correct verification of your age and that the recipient of any product is over the age of 18.

 

SUPPLY

 

Some products contain nuts, egg, milk and other allergens. Please refer to product packaging and/or the website for further information.  If you have any questions concerning allergen information, please contact us at info@cotswoldedgehampers.co.uk.

 

All contents have been fairly described through the contents list and photographic props such as demonstrative foods and drinks, plates, glasses, cutlery and other utensils are not included unless stated.

To make the most of the goods content, we recommend that the food and drink items are consumed as soon as possible after delivery. Some items can be kept for many months, but some require immediate consumption and refrigeration, these include but are not limited to cheese, cream, fruit, bread, meats and cakes. We cannot accept liability for spoiled products if the items in the order are not stored in the correct manner once delivered.

Please note that food items may contain allergens such as nuts, egg, milk and gluten and you should be aware that our hampers are stored and packaged in environments in which nuts may be present. Details of ingredients of items are as supplied by the manufacturer, are shown on manufacturers’ packaging, and are available on request.

The weights given are approximate only and packaging may vary from those shown.

 

In the event of supply difficulties, we reserve the right to substitute goods or packaging of equal quality and value.  Wine vintages and labels may vary from those shown.

 

All items featured within our website are subject to availability.

 

Items containing alcohol can only be ordered by and delivered to persons aged 18 and over.

 

The product images shown on the website are intended for presentation purposes only. Gifts and their contents are configured for safe and secure transit using the appropriate packaging methods, employed at our discretion.

 

Our baskets and wooden boxes are hand-made from natural materials, therefore weave styles and willow colours/shades/finishes may vary from examples pictured.

 

DELIVERY

 

We will do our utmost to ensure deliveries are made on the requested date, please note that such dates serve as estimates only and cannot be guaranteed in any way.  We are unable to deliver on Bank Holidays.

 

Any claim for non-delivery of any goods shall be notified in writing by the customer to us within 5 days of the intended delivery date. Any claim for damage to any goods shall be notified in writing by the customer to us within 24 hours of delivery.

 

Regardless of how the order is communicated to us (on-line, e-mail, telephone, etc.), it is the customer’s responsibility to ensure that all order and delivery details are correct at least two working days prior to despatch. 

 

Our guarantee is limited to delivering to the building, not individual recipients.

 

We do not accept any responsibility for any loss, damage, delay or other disruption in supply and deliveries brought about as a result of any of the following:

 

  • inaccurate or incomplete delivery address details;

  • delayed payment (cleared funds);

  • delayed order receipt.

 

We reserve the right to charge the customer an additional fee for carriage, repeat handling or unusable content in the event of a failed delivery caused by the supply of an incorrect or incomplete delivery address by the customer, or due to recipient absence.

 

ORDERING

 

All goods remain our property until they have been paid for in full (cleared funds).  Orders are not accepted until the point of despatch.

 

Prices quoted are subject to change without notice.  If any item is out of stock, we will inform you and wherever possible provide details of alternatives.  Many of our items are from small scale artisan producers. We do our best to keep stocks high but during periods of high demand it may be necessary to substitute an item. In these cases, the item will be of a similar type and value.

 

No order which has been accepted by us may be cancelled by the customer except with the agreement in writing of us and in terms that the customer shall indemnify us in full against all loss (including loss of profit), cost (including the costs of all labour and materials used), damages, charges and expenses incurred by us as a result of cancellation.

 

Payment may be made by credit/debit card or by Paypal Account.

 

CANCELLATION AND RETURNS POLICY

 

You may cancel your order up to 48 hours prior to the dispatch date.  This will incur a small administration charge of £10.  

 

If you are not happy with your hamper*, please contact us within 24 hours to arrange return.  The full value of the hamper will then be refunded on receipt of undamaged and/or in date goods (excluding postage as this is free), provided you comply with the below:

 

  • The goods remain unused and component parts are unopened. 

  • You or the recipient retain and take reasonable care of the goods and package the goods to be returned securely in the original packaging, including details of your order number. 

  • You are responsible for returning the goods to us at your own cost.

  • Refunds will be issued upon safe receipt of the item. Refunds will be made via the original payment method. 

  • If goods are returned to us via the courier following unsuccessful attempts at delivery and where any delivery instructions have been met no refund will be made.  In these circumstances the customer may request that the goods be resent.  This would incur a standard delivery charge and would not cover any spoilt perishable goods.  We will not make any administration charge for dealing with these cases.

 

EXCEPTIONS

 

If your order contains any of the following items we will be unable to refund or replace your order once it has been delivered:

 

  • Fresh items (including cheese, meat, fish, fruit or flowers)

  • Temperature controlled produce (produce requiring storage at controlled temperatures)

  • Personalised and branded goods

  • Bespoke products.

 

THIRD PARTY LINKS

 

The website may from time to time include links to other websites or material. The Company is not liable, directly or indirectly, for the privacy practices or content of these other websites. The Company is not liable for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services on such external websites.

PERSONAL INFORMATION AND PRIVACY

Personal information provided to us will be used for the purposes outlined at the time of collection.  We may use your information for:

  1. Processing your orders

  2. For statistical or survey purposes to improve this website and its services to you

  3. To serve website content and advertisements to you

  4. To administer this website

  5. If you consent, to notify you of products or special offers that may be of interest to you and may be used for statistical analysis, to provide goods and services including marketing advertising and promotions.

We will treat all your personal information as confidential and will only use it in accordance with all applicable UK data protection and consumer legislation.  However, no data transmission over the internet can be guaranteed to be totally secure. As a result, whilst we strive to protect your personal information, we cannot ensure or warrant the security of any information which you send to us, and you do so at your own risk.

We do not store or record any of your credit or debit card details.  We use a third party payment gateway (currently Paypal) to help ensure the highest level of security for our customers.

You agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003. 

 

You should be aware that this site is being monitored and may capture information about your visit that will help us improve the quality of our service.

The information we collect and store from you is set out on the web page used to collect it.  This enables us to assist your use of the site as well as process orders.  This information includes:

  • Your name

  • Your address

  • Your telephone number

  • Your e-mail address

  • Recipient name(s) (if provided)

  • Recipient address(es) (if provided)

  • Recipient phone number(s) (if provided)

  • Special requests and notes relevant to the provision of customer services

  • In addition, we may collect your IP address and use cookies to allow the correct function of the site. 

 

We gather statistics relating to e-mail opening and clicks using industry standard technologies to help us monitor and improve our services.

 

If you subscribe to mailings, you can unsubscribe using the link which would be clearly shown on our communication or by e-mailing us directly (info@cotswoldedgehampers.co.uk).

We never rent or trade e-mail lists with other organisations and business nor do we disclose your information to third parties for marketing purposes. In certain circumstances we may disclose or access your account if required to do so by law or by any governmental body.

We review our privacy notice regularly (last reviewed in June 2020).

INDEMNITY

You agree to fully indemnify, defend and hold the Company its officers, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms by you, or any other liabilities arising out of your use of our website or any other person accessing the website(s) using your personal information.

FORCE MAJEURE

 

We shall not be liable for any failure in the performance of any of our obligations under this Agreement caused by factors outside our control.

 

LAW AND JURISDICTION

 

This agreement shall be governed by English law.
